Article 1: General provisions

The e-commerce website of A Full Metal Jacket, a BV with registered office at Leistraat 19, 9450 Heldergem, Enterprise Number: BE0735794983, offers its customers the opportunity to purchase the products from its online shop.

These Terms and Conditions apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the A Full Metal Jacket online store, the Customer must expressly accept these Terms and Conditions, which agree to the applicability of these Terms, excluding all other conditions. Article 5: Supply and implementation of the Agreement

Items ordered through this webshop are delivered all over the world with the exception of a few countries due to certain reasons such as unforeseen crises.

The delivery is made by a parcel service (DPD, Bpost or DHL) or via the company’s own courier.

Unless otherwise agreed or expressly otherwise specified, the goods will be shipped to the customer’s place of residence within the specified time limits. If this is to be deviated from, the customer will be contacted as soon as possible.

The collection of packages at AFMJ by the courier is always on working days. During the weekend or public holidays, the day of a collection moves up during the duration of the public holiday. For example. If you place an order for an item that is in stock on Saturday, this item will be shipped on Monday. For example. If you place an order for an item that is in stock on a public holiday that falls on a Monday, this item will be shipped on Tuesday.

If an order consists of several items and one or more of those items is indicated as a backorder with the order, A Full Metal Jacket will always wait until the order is complete before shipping. However, the risk is already passed on to the Customer upon delivery to the carrier, if the customer’s carrier has been instructed to transport the goods and this choice was not provided by the A Full Metal Jacket.

Article 6: Reservation of ownership

The delivered items remain the exclusive property of A Full Metal Jacket until the time of full payment by the Customer.

The Customer undertakes, if necessary, to designate third parties to the reservation of ownership of A Full Metal Jacket, e.g. to anyone who would seize the items not yet fully paid.

Article 7: Right of withdrawal

The terms of this article apply only to Customers who, in their capacity as consumers, purchase items online from A Full Metal Jacket Shop.

Where the right of withdrawal applies:

The Customer has the right to revoke the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically acquires the last good.

In order to exercise the right of withdrawal, the Customer must inform “DE LEI” at Leistraat 19, 9450 Heldergem, via an unambiguous statement (e.g. written by post, fax or e-mail) of his decision to rescind the agreement.

In order to comply with the withdrawal period, the Customer must send his notice regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return the goods to “DE LEI” at Leistraat 19, 9450 Heldergem without delay, but in any case not later than 14 calendar days after the day on which he communicated his decision to revoke the contract. The Customer is on time when he returns the goods before the 14 calendar days deadline has expired.

If the Customer rescinds the agreement, “DE LEI” will refund all payments received to that point from the Customer, including the standard delivery fee, to the Customer within a maximum of 14 calendar days after “THE LEI” has been notified of the Customer’s decision to rescind the agreement. In the case of sales agreements, “DE LEI” may wait until he has recovered all the goods, or until the Customer has demonstrated that he has returned the goods, whichever is the time.

Any additional costs resulting from the customer’s choice of delivery other than the cheapest standard delivery offered by “DE LEI” will not be refunded.

“THE LEI” reimburses the Customer using the same means of payment as the customer made the original transaction, unless the Customer has expressly otherwise consented; in any case, the Customer will not be charged for such a refund.

The Customer cannot exercise the right of withdrawal for:

  • service agreements after the full implementation of the service;
  • the supply or provision of goods or services the price of which is subject to fluctuations in the financial market over which A Full Metal Jacket has no influence and which may occur within the withdrawal period;
  • the supply of goods manufactured according to the customer’s specifications, or which are clearly intended for a specific person;
  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
  • agreements in which the Customer has specifically requested A Full Metal Jacket to visit him in order to carry out urgent repairs or maintenance there;
  • the provision of accommodation other than for residential purposes, freight transport, car hire services, catering and leisure services, if the agreements provide for a certain date or period of implementation;
  • the delivery of digital content that has not been delivered to a material medium, if the execution has begun with the express prior consent of the Customer and provided that the Customer has acknowledged that he will lose his right to withdraw (e.g. downloading music, software);

Article 8: Guarantee

Under the Law of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee leaves these rights undiminished.

In order to appeal to the warranty, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer should contact the A Full Metal Jacket customer service and return the item to A Full Metal Jacket at his expense.

If a defect is defict, the Customer must inform A Full Metal Jacket as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its adoption. After that, any right to repair or replacement will be cancelled.

The (commercial and/or legal) warranty never applies to defects arising from accidents, neglect, falls, use of the article contrary to purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest after a period of 6 months following the date of purchase, if any delivery, are deemed to be not hidden defects, except rebuttal by the Customer.
